Terms & Project Agreement

Project Scope & Services

By submitting a project enquiry or accepting our proposal, you agree to work with Shayne's Designs under these terms.

What We Offer

• WordPress Migration: Full audit, content restructure, migration to static site, testing, and launch. Typical timeline 2–4 weeks.
• Bespoke New Build: Discovery, positioning strategy, design, custom code, testing, and launch. Typical timeline 4–8 weeks.
• Ongoing Partnership: Post-launch support, updates, monitoring, and optimisation at $300/month (optional).

What We Don't Provide

• Template-based builds or page builders
• Guarantees on search rankings, traffic, or sales
• 24/7 emergency support (standard support is business hours, 24-hour response target)
• Unlimited revisions beyond the agreed scope

Discovery & Agreement

Every project begins with a discovery conversation. We discuss your business, audience, goals, budget, and timeline. Based on this conversation, we provide a written proposal including:

• Scope of work and deliverables
• Project timeline and key milestones
• Investment (total cost or monthly fee)
• Payment schedule and terms
• Revision limits and approval points

Both parties must sign the proposal before work begins. Any changes to scope requested after signing will be quoted separately and require written agreement.

Payment Terms

Payment Schedule

• 50% deposit to begin work (required before project starts)
• 50% balance due on final delivery (due before site goes live)

For ongoing partnerships ($300/month), payment is due in advance on the 1st of each month.

Payment Methods

We accept bank transfer, PayPal, and Wise. Invoices are sent once and payment is expected within 14 days of invoicing.

Late Payments

If payment is more than 14 days overdue, we will pause project work and support until payment is received. If payment is 30+ days overdue, we reserve the right to suspend all services and may pursue collection.

Currency

Pricing is quoted in USD unless otherwise stated. Bank fees and currency exchange costs are the responsibility of the client.

Revisions & Approvals

The proposal specifies the number of revision rounds included. Each round allows for feedback and changes to approved deliverables (design mockups, copy, layout, etc.).

Included Revisions

• WordPress Migration: up to 3 revision rounds
• New Build: up to 4 revision rounds (strategy phase included)

Additional Revisions

Revisions requested beyond the agreed limit are billed at $60/hour. We'll notify you before starting additional revision work.

Approval Points

Project approval happens at key milestones (strategy, design, development preview, final delivery). Your sign-off at each milestone allows us to proceed to the next phase.

Hosting, Domains & Email

Hosting

We deploy your site to Vercel (CDN & hosting) included at no extra cost. The site is fast, secure, and globally distributed. You own the site and can move it elsewhere anytime.

Domain & Email

You own your domain name and email. We help set up DNS, email forwarding, and SSL certificates. You can manage these yourself or request our help (charged at $60/hour if outside project scope).

Backups & Uptime

Your site code is version-controlled on GitHub. We maintain backups. Vercel SLA guarantees 99.9% uptime, though static sites have extremely high availability. We cannot guarantee 100% uptime (no service provider can).

Ownership & Intellectual Property

Code Ownership

You own the site code, design files, and all deliverables 100%. You receive full source code, documentation, and the ability to edit or move the site yourself. No vendor lock-in, no proprietary templates.

Design Assets

You own the website design. You can use design elements for your business. You may not resell the design as a template or transfer it to other businesses without explicit written permission.

Client Content

You own all content (copy, images, videos, documents) you provide. We may use screenshots of the final site in our portfolio with your permission (always requested).

Support & Maintenance

Post-Launch Support (30 Days Free)

After launch, we provide 30 days of free support covering bug fixes, broken links, browser compatibility issues, and minor content updates. This does not include new features or major design changes.

Ongoing Support ($300/month, Optional)

If you choose ongoing partnership, you get:

• Monthly performance monitoring and reporting
• Security updates and patches
• Up to 10 hours/month of updates, content changes, and optimisation
• Priority email/WhatsApp support (24-hour response target)

Support Scope

Support covers bug fixes, updates, and minor improvements. New features, major redesigns, or third-party integrations beyond the original scope are quoted separately.

Support Termination

You can pause support anytime with 30 days' notice. We'll provide handover documentation. The site continues to run indefinitely with no further fees (hosting is perpetual, code is yours).

Cancellation & Refunds

Before Work Begins

If you cancel before work starts, we'll refund your deposit in full (minus any third-party costs like domain setup, if applicable).

During Development

If you cancel mid-project, we'll refund a prorated amount based on work completed, minus deposit (no refund of deposit). You receive the work completed to date and all assets created so far.

No Refunds After Launch

Once the site is live and you've accepted delivery, refunds are not available. You own the site and can request changes (subject to support scope and costs).

Our Cancellation Right

We may cancel a project if: (a) payment is 30+ days overdue, (b) you request work outside our expertise or scope, or (c) abuse or harassment occurs. In this case, we'll provide notice and return your deposit minus hours worked at $60/hour.

Warranties & Limitations

We do guarantee:

• High-quality, clean code that's auditable and maintainable
• Site will be tested and working before launch
• Performance testing and optimisation per project scope
• Honesty about what's possible and what isn't

Dispute Resolution

If a dispute arises, we'll attempt to resolve it through good-faith discussion. If that fails, disputes will be handled through arbitration under the laws of Thailand (or your local jurisdiction if applicable). Legal action is a last resort.

Confidentiality

Both parties agree to keep project details and client business information confidential. We will not share client details, project work, or business information without explicit permission—except where required by law.
